Friendly’s Privacy Policy covers all data collected and used by Friendly’s. In addition, this Children's Privacy Policy provides further information and privacy protections for the use of any of the Friendly’s websites (individually and collectively, the "Website") targeted to children who are under 14 years of age.
Information Collection and Use
Under the Children's Online Privacy Protection Act ("COPPA"), no website operator can require, as a condition to participation in an activity, that a child younger than 13 years of age disclose more personally identifiable information ("PII") than is reasonably necessary.
Friendly’s complies with this requirement and only collects PII from children under 14 that is voluntarily provided and that the child's parent/legal guardian has assented to.
Although children under 14 may be allowed to participate in some contests, sweepstakes and promotions, they must provide a parent or legal guardian's email address. We send the parent/legal guardian an email when their child registers to enter a sweepstakes or contest or to participate in any ongoing activity on the Website and we provide the parent/legal guardian forty-eight (48) hours to refuse their child's registration and entry into the sweepstakes or contest or further participation in the ongoing activity offered on the Website. If the parent/legal guardian refuses to allow the child's registration and/or entry, we delete the child's information from our database. If we don't hear back from the parent/legal guardian, we assume it is acceptable for the child to be registered and entered into the sweepstakes or contest or participate in the activity. Once a parent/legal guardian permits a child to register, the child will be able to enter future registration based sweepstakes or contests or participate in any ongoing activities offered on the Website without further notification to the parent/legal guardian until such time as the parent/legal guardian revokes such registration or the child turns 14 years of age. If a child wins a sweepstakes or contest, we notify the parent at the parent's email address provided to us during registration and request that the parent provide their postal address for purposes of delivering the prize. We may publish a winner's first name, first initial of last name, city, and state of residence on the Website.
Information Sharing and Disclosure
Friendly’s does not share children's PII with anyone, except as herein set forth. No PII collected from children under 14 is used for any marketing or promotional activities. Friendly’s will share PII about a child with other third parties providing services on our behalf, such as in connection with the winning of a prize or when we need to send the information to companies that work on our behalf to provide a product or service that has been requested by a parent on behalf of a child. We may also disclose children's PII in order to respond to subpoenas, court orders or legal process, to the extent permitted by law, or when any future subsidiaries, affiliated companies or successor companies (resulting from a merger or acquisition) have a need for such information. Unless we tell you otherwise, any companies that work on our behalf to provide a product or service do not have any right to use the children's PII we provide to them beyond what is necessary to assist us.

The Website may contain links to other websites whose privacy practices may be different than ours. Users should consult the privacy notice at the particular website to which they link to ascertain the practices there.
Ability to Update or Delete Information
In the event that Friendly’s collects and retains PII pertaining to a child under 14, the parent/legal guardian may send an e-mail to us to review, change and/or delete such PII as well as to refuse to allow any further collection or use of the child's PII. At any time, a parent/legal guardian can refuse to permit us to collect further PII from their child and can request any PII we have collected be deleted from our records.
Notification of Changes to Children's Privacy Policy
We may amend our Children's Privacy Policy at any time. We will provide parents/legal guardians notice by email of any material changes in the way we intend to collect, use, and/or share children's PII. In any case, parents/legal guardians should make sure that we have their current email address. We will apply material changes in our Children's Privacy Policy only in conformance with applicable law, including any applicable provisions of COPPA that require parental consent.
